What rights does a co-signer on a house have… in Texas.?
February 6th, 2010 | by admin |I was dating a girl and she bought a house. To lock in a good rate, her mother cosigned on the house. Three years later, the girl and I are married and her mother does not like me one bit. Several times her mother has called screaming and yelling saying that she is putting the house up for sale. Can she do this? Can she make us buy her out? Does she own half the house? She was just a cosigner. The central appraisal district shows my wife as 100% owner. What; if anything, can my wifes mother do? And where do I fit in as far as ownership goes? We are married now. Any help will be greatly appreciated.
She is just a co signer which means they can contact her for payments is you do not make them, she is not on the title just the loan, so no she does not have the right to sell it. Buy her out no she owns nothing on the property, what you can do is refinance it to get her off the loan. She owns no part of your home, and has no say so in it. Again as co-signer of the home yes she is responsible if you do not make the payments, but she owns no percent, and has no decision power in the home whatsoever, and as such has no legal recourse. Would advise if possible to remortgage getting her off of it, or let her rant and rave there is nothing she can do

In general she can do nothing, if she is not on the deed, at this point she is just a co-signer guarantor of the note, as long as you guys keep the payments up to date,
she in my opinion has no recourse to sell the land since she is not on the title nor does she have the right to try and cancel the note if you are current with the payments nor will the lender release her

She has absolutely no ownership rights unless she is on the title. She has the right to pay the loan if your wife defaults. You have only the rights of community property.
I’d suggest you check into a re-fi to get her nose out of your business.
